I am not forcing anyone, if someone chooses not to pray after knowing the consequences then that's upto them and Allah.

From all I have read, the only times it was used that way originally was at times of war - when soldiers would refuse to fight.

I do not why, but here's how the fuqaha have interpreted the evidence for missing out prayers.

The position of the overwhelming majority of scholars is that intentionally leaving prayers, though a major sin, is not unbelief unless accompanied by denial of the obligation of praying. [Mawsu`a Fiqhiyya; Radd al-Muhtar; Majmu`]

Not just the letter, but also the spirit. Many scholars including the ones from Al Azar have pointed out the conditions for hudood are VERY high, plus mercy is encouraged, remorsefulness negates the full punishment, but not the conviction, according to some scholars. You cannot blame a judge for not applying the top punishment when not all the conditions have been fulfilled.
