Merseyrail is the only rail company to prosecute passengers for putting their feet on seats. About 250 people have been taken to court since the scheme was launched in February.
A company spokesman could not comment because of the impending court case but said the "feet-up" policy had been widely publicised. Stickers are placed on trains and Tannoy announcements made.
It is in response to "passenger feedback" under steps to tackle anti-social behaviour. The spokesman also said that the company had spent £32 million refurbishing its fleet.
Enforcement officers wearing CCTV "head cams" patrol carriages and prosecutions are based on railway bylaws regarding "unacceptable behaviour".
Kathleen's father, Tony, said: "Kathleen has always been an A* student and is a good, considerate girl.
"Why couldn't a fixed penalty notice be given? She could end up with a criminal record on her CV, which could affect her future. It's madness."

The couple were produced before a magistrate in Jalpaiguri on Monday.
But as the lower court has no criminal jurisdiction, Ali and his wife were released.
"The police have not lodged any specific charge against Afazuddin (Ali) and my court has no jurisdiction over criminal matters, so what can I do," sub-divisional officer Atanu Roy said.
Angry villagers say that is not good enough.
"The girl is a minor, so at the very least her father should face criminal charges for marrying a minor," villager Sheikh Ramzan said.
Ali and his wife have not returned home because they fear a fresh attack from angry villagers.
They are staying in Jalpaiguri town at the moment.

A British primary school teacher has been arrested in Sudan accused of blasphemy for allowing her pupils to name a teddy bear Muhammad, it emerged today.
Gillian Gibbons, 54, from Liverpool, was arrested yesterday at her home inside Unity high school, a British international school, after a number of parents made a complaint to Sudan's education ministry.
Gibbons's colleagues told Reuters they feared for her safety after receiving reports that young men had already started gathering outside the Khartoum police station where she was being held.
The School's Director, Rober Boulos, said Gibbons was following a national curriculum course designed to teach young pupils about animals and their habitats. This year's animal was the bear.
Gibbons, who joined Unity in August, asked the class of mostly seven-year-olds to name the toy.
"They came up with eight names including Abdullah, Hassan and Muhammad. Then she explained what it meant to vote and asked them to choose the name." Twenty out of the 23 children chose Muhammad.
Each child was allowed to take the bear home at weekends and was told to write a diary about what he or she did with the toy. The entries were collected in a book with a picture of the bear on the cover, next to the message "My name is Muhammad," said Boulos.
Boulos said the first he knew about the course was last week when he received a phone call from the ministry of education, saying a number of Muslim parents had made formal complaints.
I thought about 90% of Muslims called their sons 'Muhammad'. Should they also get charged with blasphemy for impersonating the Prophet (saw).

This is to symbolise the fact that Bethlehem is now part of the Occupied Territories of Palestine and Israel have shut them off from the outside world.
The wooden models are made by Palestinian craftsmen and all proceed go to helping Palestinian projects.
There is also a Virgin Mary (ra) USB memory stick, for some obscure reason.
