ok, the doctor guy is too softly spoken, can be hard to keep the attention.

I actually listened to it. A couple of points made in there that were interesting:
During the time of the Prophet (saw), there was no enforcement of some rules of islam:
1. If people (munafiqeen - hypocrites that were following for reasons other than belief) chose to ignore the order for jihad, they were not forced to fight.
2. The punishment meeted out for not paying zakaah was not to accept that person's zakaah in the future.
(other criminal activity was punished afaik, such as theft, murder etc.)
After the Prophet (saw)'s passing away, these and other things had to change as the Muslim leadership now also had a political element to it, so the state had to enforce more stuff.

Instead of killing them (or any other punishement, for that matter)
Don't just do something! Stand there.
Not in the same vein of physical punishments. It is only a punishment for those that see the error of their ways - otherwise you'd think you got off scott free.
